(applause) >> our speaker this morning, the former secretary of defense william perry, i first met when he was the deputy secretary of defense, and he and mrs. perry came to korea where i was the c5j5 and i was assigned to escort them around. and i had a lot of those kinds of duties while i was assigned to korea. but it was the most pleasant experience i had and i say that honestly, to get to know these two people. and he then became our secretary of defense. and many of us that have served thought that he was one of the best secretary of defenses we've ever had. he's currently a senior fellow at the hoover institute and a freeman foley institute of international studies. he is the michael and barbara bavarian professor at stanford university and serves as co-director of the nuclear risk reduction initiative and preventive defense project. please help me welcome our speaker this morning, former secretary of defense william perry. . the department of defense is very comprehensively represented here at fleet week this year, more so than ever before. we have a representative from the assistant secretary of defense for homeland defense and american security affairs in the audience and they were here in august when we did our exercise with the city. fema is well represented and we have several defense coordinating officers here over the past couple of days. certainly the california national guard is represented heavily here. obviously they are going to be the first guys to respond to a disaster and they have several interesting roles not only from a state perspective but as they get federalized or with the dual status commander managing federal response and federal authorities of military authorities flowing in. and most significantly, we're represented today with the commander of northern command, general jackoby. as you know, defense report to civil authorities is not a primary mission area for the department of defense. we have codified it in policy over the years and certainly things have advanced since 9/11 and hurri

-sex marriage. the first one is about the defense of marriage act, windsor against the united states. edith windsor and her partner were married in toronto, canada in 2007. spire died in 2009 in new york at a time when new york recognized same-sex marriages that had been performed outside the side. when spire died windsor was required to pay $363,000 in federal estate taxes on her inheritance that she would not have had to pay if federal law had given their relationship the same status that opposite sex marriages get, so a pretty clean case here, an even the obama administration has already said it doesn't think the constitutionality of the defense of marriage act can withstand a legal attack. >>> the second case the court decided to take on is proposition 8, the california ballot initiative adding a state constitutional amendment in 2008 that said only marriage between a man or woman is valid or recognized in california. it overturned a court ruling that said same-sex couples have a right to marry. the cases are likely to be heard in march and decided some time in june. randi? >> joe johns

defense cuts. in fact, both sides have gone out of their way to say they shouldn't happen. but if there's no deal, they may happen anyway. in today's "deep dive" how the sequester could impact our military, our economy, and our safety. the budget control act calls for about a trillion dollars in automatic cuts to begin in january if laes no deal. half would come from domestic spending. we'll dig deeper into that. today spes cifically about the half that comes from security and defense. the cuts on that side amount to $492 billion over the next ten years but they aren't across the board. the president has promised to exempt military personnel and veterans affairs. let me start this here. here is the $492. that, by the way, this $492 billion is on top of another $450 billion cuts the d.o.d. was planning to make to cut waste and trim unnecessary programs. it's prompted mrenting of hand wringing on both sides. >> we can't afford another $500 billion in cuts in our defense budget on top of the $500 billion in cuts that the president is already making. >> the sequester destroys the united sta

fire recognizes that you great folks have a primary mission, that's defense of the nation and we respect that and we understand this is an ancillary job and there is a high revel of rotation of people coming back from afghanistan or iraq, whatever the case may be, but we also reach out to squadron level training. it really comes down to meeting with your cooperating agencies and training together on a frequent basis and having good and open dialogue. >> as i look back at that map here, knowing we were heading into that time of year where we're going to hit significant fire weather and knowing northern california as we are now but eventually southern california, one of the most effective ways to stop the fires from growing is that initial attack, which means we need to be able to quickly put resources up in the air and move them. i guess my question is from a national guard perspective, from a naval perspective, with the helicopter resources down there, do you feel you would be able to quickly move those resources and you have the agreements in place. we'll start with the nation

cuts and tax increases but spending cuts particularly in defense. they don't want that. >> explain why what they agree on -- namely that the middle class, 98% of all taxpayers, that their taxes will stay the same, they will not go up. if everyone agrees at least on that, the president says, go ahead and pass that. why not just eliminate the 98% who won't have any changes, those making under $250,000? why not allow that to go forward? why are the republicans resisting on that. >> it could wind up there, wolf. but if the republicans lose that, they believe they kind of lose the leverage that they have. if they sort of give on that, then where's their leverage with the white house? so i think that in the end, wolf, if i had to bet -- and i don't like to bet on these things because they always disappoint -- but i would have to say that the one thing they are all likely to do at some point is to make sure the taxes do not go up on the middle class. but in order to do that, republicans want to get some concessions for that. it seems very easy to do that. democrats have done it in the past. a

to be on the table. entitlements are 13 percent of the total budget. the big pot is defense spending. we spend trillions on defense. federal pension that is 22 percent of the federal budget. we give pensions to members of congress and lt's look at that and look at entitlements and look at the big honey pot and the big spending. >> i am all with mark in bringing down the pensions of the politicians. here are the facts, in 2009, we had a stimulus spending. 800 billion extra from 2008. guess what, it never stopped. it was supposed to be a one stop 2010 and 11 and 12 we have maintained the extra spending in a time when we had cut back on military spending. >> absolutely. >> and that is increasing and guess what, that adds up to the deficit, right? >> david, the problem is deeper than wh you are describing. this goes back decades. when you look at entitlement spending over the last half century, it has steadily crept up four percent every year and that includes adjustments for pulation growth. so what then? you increase taxes four percent every year? that is absurd. at some point we need both parts

or four years before you have to make the changes, but there is no defense to making the changes. even if it is a historical building. that is not a defense. when i get involved, it is because 90% of the time, the tenant is the only one who gets the notice, though the notice is addressed both to the tenant and landlord. next thing you see, you are handed a piece of paper by some stranger, and it is a lawsuit. then you need to find a lawyer. probably 90% of these cases are in federal court. it becomes much more costly to get a lawyer involved. most lawyers charged somewhere between $5,000 or $10,000 to get involved in some of these cases. you need to file a formal answer in the court. you will be in a mediation process, which means you will meet with people appointed by the court to try to resolve this issue. the revolution is just what i said. it is major repairs if they are appropriate, and not all repairs are in demand. and, to settle the damaged portion of the case. in my experience, the damages claimed usually run somewhere between $15,000 or $5,000, and attorneys fees generally ru

on the diagnosis -- the docket on the defense of marriage act and a portion only recognizes marriage as between a man and a woman and has been challenged dozens of times. they agreed to take up a case dealing with defense of marriage act. two different cases but both going to the same issues. they are different on technical and legal points but the bottom line is the same and the court has told us it will hear two gay marriage cases and we expect the earliest to get on the calendar is march of 2013 so that means we will have a decision like we did with the president's health care law in late june next year. >>shepard: has the supreme court or members given any indication of where they are these days on these matters? >>shannon: when they grant the cases all we know there were four votes behind closed doors from the nine justices and it takes four votes to get the cases on the docket so there are that many who are interested. we thought they might take either of the defense of marriage act or proposition 8 but because they involve differences in the legal issues involved, it looks like they want

has a bright line. it says if you engage in a wongful action, there is a defense called the insanity defense which never works as most of us know because we don't recognize it. should we recognize it, that's an interesting question. should we have a more robust concept of diminished responsibility in light of the understanding that some people have less control over their preferences and desires or should we have better sentencing schemes or get rid of incarceration and come up with different models of trying to deal with punishment once we understand people have wrong selections. i think those are all interesting questions, but is there free will? well, the fact that almost everybody in the audience raised either their right or left hand contemplated it and were quickly able to act and respond. that to me says, yes, there is. now what do we want to do about it? now that we understand that those of us in the audience or up here that like chocolate cake may not have control over it, how do we want to account for that if at all in the criminal justice system? to date, we haven't. in th

that in the senate. in terms of saving money on defense, you are right, and we are. the two sides agreed to over $500 billion in defense cuts. people say is this funny money, is it real? it is not something i am in favor of because we live in a dangerous world we will lose 75,000 soldiers. we wanted to have 213 combat vessels. we will have 288. this is real reduction. i think the secretary of defense, secretary leon panetta has -- will tell you we have gone as far as we can safely go. i think both sides, and the president, i do not think we want military capability lower. i think we have saved as much as we possibly can. in terms of the other things, after the bush tax cuts came to thousand three, and revenue is higher than it was in 2003, and generated a lot of growth, and the deficit with the last republican majority leaving office -- our problem is a spending problem. we're spending a lot more money than we were then when the president came into office. we're putting off dealing with entitlement programs. we will double the people on medicare in the next 20 years. we should focus on where the prob
